Subject: Representative Fees

Background

This transmittal amends “Evidence or Allegations of Violations of Law,” section I-1-2-81 in the Hearings, Appeals and Litigation Law (HALLEX) manual chapter I-1-2. The amendments update instructions on referring possible representative misconduct when the inappropriate behavior relates to a representative's fee.

Explanation of Content and Changes

I-1-2-81 A – We added subsection A, titled “General,” and provided basic information on referring a possible violation of our rules about representatives' fees.

I-1-2-81 B – We added subsection B, titled “Referring a Suspected Violation to ODAR Management.” In the subsection, we updated the procedures for preparing a referral to the Office of the General Counsel (OGC), Office of the Regional Chief Counsel (ORCC).

I-1-2-81 C – We added subsection C, titled “ODAR Management Referrals to OGC.” In the subsection, we explained a manager's responsibility in referring a suspected violation to the ORCC.

I-1-2-81 D – We added subsection D, titled “OGC Action After Referral,” referencing HALLEX I-1-1-50 B, which provides a general outline of how OGC processes referrals.
