Subject: Dismissals

Background

This transmittal adds section I-2-4-11 to the Hearings, Appeals and Litigation Law (HALLEX) manual to provide instructions when an administrative law judge (ALJ) has dismissed a case and wants to vacate the dismissal, but the Appeals Council now has jurisdiction of the case.

Explanation of Content and Changes

I-2-4-11 – We titled the section “Requesting Jurisdiction From Appeals Council When Request for Hearing Was Dismissed” and provided instructions for how an ALJ may request that the Appeals Council return jurisdiction to the ALJ when the ALJ dismissed the request for hearing and the ALJ now wants to vacate his or her dismissal order.
