Subject: Initial Processing of a Request for Review

Background

This transmittal adds section I-3-1-23 of the Hearings, Appeals and Litigation Law (HALLEX) manual to incorporate instructions previously in HALLEX section I-3-0-71 for contacting a hearing office to locate a missing claim(s) file.

Explanation of Content and Changes

HALLEX I-3-1-23 is organized as follows:

I-3-1-23 A – We incorporated the information previously in HALLEX I-3-0-71 A with minor editorial corrections.

I-3-1-23 B – We incorporated the information previously in HALLEX I-3-0-71 B with minor editorial corrections.

I-3-1-23 C – We incorporated the information previously in HALLEX I-3-0-71 C with minor editorial corrections and a reference to the instructions in subsection D, when applicable.

I-3-1-23 D – We added new subsection D titled “Missing Claim(s) File” to address situations where queries show hearing office staff sent a paper claim(s) file to the Office of Appellate Operations (OAO), but OAO did not receive the claim(s) file.
