Subject: Workup of Case by Analyst

Background

This transmittal amends section I-3-1-25 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update information and clarify procedures analysts use when referring bias allegations to the Office of Appellate Operations Executive Director's Office. We clarified the distinction between a referral for a bias allegation and a referral for possible non-compliance with policy. We also made other minor formatting and language changes to improve the readability of the provision.

Explanation of Content and Changes

HALLEX I-3-1-25 A – We made minor editorial language changes.

HALLEX I-3-1-25 B.1. – We made minor editorial language changes and added a NOTE that explains how an analyst can refer possible non-compliance with policy that may warrant feedback to the hearing operation but does not warrant referral to the Division of Quality Service.

HALLEX I-3-1-25 B.2. – We made minor editorial language changes and added instructions for the referral of bias allegations present in a paper claim(s) file.

HALLEX I-3-1-25 B.3. – We made minor editorial language changes and clarified the appropriate language to acknowledge an allegation of bias in remands, decisions, and interim action documents.

HALLEX I-3-1-25 C – We made minor editorial language changes. We also added a NOTE that clarifies when an administrative appeals judge can refer egregious administrative law judge conduct or possible non-compliance with policy.
