Subject: Initial Processing of a Request for Review

Background

This transmittal adds section I-3-1-14 in the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions for processing a claimant's request for an extension of time (EOT) to submit additional evidence or arguments.

Explanation of Content and Changes

HALLEX I-3-1-14 incorporates and updates information formerly in HALLEX I-3-0-85. In subsection A, we updated the general information regarding when a claimant or his or her appointed representative may request an EOT to submit additional evidence or arguments. We clarified that the Appeals Council (AC) will accept the request in writing or by telephone. We also clarified that the AC will evaluate subsequent EOT requests, or EOT requests for more than 25 days, using the good cause standards in 20 CFR 404.911, 405.20, and 416.1411. In subsection B, we explained the general procedures for receiving an initial EOT request and the procedures when a claimant or appointed representative submits a subsequent EOT request.
