Background

This transmittal adds section I-3-0-65 to the Hearings, Appeals and Litigation Law (HALLEX) manual to incorporate instructions relating to the expedited appeals process (EAP).

Explanation of Content and Changes

I-3-0-65 – We added a new section titled “Expedited Appeals Process — Constitutional Challenge to Social Security Act” and incorporated information previously in HALLEX I-3-5-60. We added a subsection A titled “General” with information about the EAP and filing an EAP request. We added a subsection B titled “Expedited Appeals Process (EAP) Request Jurisdiction” explaining the component that will have jurisdiction when an EAP request is filed. We added a subsection C titled “Receipt of an EAP Agreement from Another Component” to incorporate instructions for handling an EAP agreement when a signed agreement is received in the Office of Appellate Operations. We revised and updated the instructions previously in HALLEX I-3-5-60 in a subsection D titled “OAO EAP Procedures.”
